Thomas Blasts Supreme Court For Allowing Retrial In Hammer Robbery Case

Justice Clarence Thomas criticized the Supreme Court for not reviewing a decision that overturned David M. Smith’s conviction for a violent hammer attack. The 6th Circuit ruled the identification process violated Smith’s due process rights, leading to a new trial. Thomas argued the decision ignored the Antiterrorism and Effective Death Penalty Act (AEDPA), which limits federal court interference in state convictions.

Thomas warned that retrials are harmful to victims and could release violent offenders. Ohio Attorney General David Yost disagreed, asserting that Smith’s conviction was backed by DNA and phone records.

Despite Thomas’ objections, the Supreme Court’s refusal to hear the case allows prosecutors to seek a retrial.

In another case, the Supreme Court rejected Montana Republicans’ attempts to use the “independent state legislature” theory to challenge state election laws, affirming that state courts can review election laws within constitutional limits.
