He is appealing a Colorado ruling that attempted to remove him from the state’s primary ballot. The Colorado judge had ruled that while Trump’s actions could disqualify him under the amendment, the president is not considered an “officer of the United States” and thus not subject to the provision. This case is significant, as courts nationwide have issued inconsistent rulings on whether Section 3 applies to presidential candidates, making a Supreme Court review likely. Constitutional experts suggest this could be a pivotal case in determining the applicability of the 14th Amendment to the presidency.
