A U.S. magistrate judge has recommended that charges against Milwaukee County Judge Hannah Dugan proceed. Dugan faces federal allegations of hindering an immigration arrest operation after reportedly helping a Mexican immigrant, Eduardo Flores-Ruiz, evade custody during a court hearing in April.

Dugan pleaded not guilty, claiming judicial immunity and arguing the prosecution violated the constitutional separation of powers. However, Magistrate Judge Nancy Joseph ruled that official duties do not shield a judge from prosecution if criminal law is violated. She said the facts and legal questions cannot be resolved by dismissing the case at this stage.

Dugan’s attorney vowed to appeal, emphasizing the importance of judicial independence. Dugan was suspended from her duties after her arrest and faces up to six years in prison and a $350,000 fine if convicted.

Flores-Ruiz, charged with illegal re-entry, agreed last month to plead guilty and face up to two years in prison, followed by deportation.

Wisconsin’s Supreme Court has temporarily barred Dugan from her judicial duties. Attorney General Pam Bondi condemned Dugan’s actions, highlighting Flores-Ruiz’s violent history, including assaults that left victims hospitalized.
