Milwaukee County Circuit Court Judge Hannah Dugan’s jury trial has been delayed as a federal judge considers her motion to dismiss charges of obstructing ICE agents. Dugan, 66, is accused of helping an illegal immigrant, Eduardo Flores-Ruiz, avoid arrest by escorting him and his attorney through a back door of her courtroom. Federal prosecutors argue she interfered with immigration enforcement, while her defense claims she acted within her judicial authority and is protected by judicial immunity.
Dugan’s attorney asserts that her actions, such as setting hearings and courtroom management, fall under routine judicial duties. However, federal prosecutors argue that judicial immunity applies only to civil cases, not criminal charges. If convicted, Dugan faces up to six years in prison and $350,000 in fines.
The Wisconsin Supreme Court has suspended her from the bench during the proceedings, though she continues to receive her salary. Dugan has pleaded not guilty and argues that federal prosecution infringes on state judicial independence.
