SCOTUS Declines To Hear Student’s Bid To Wear ‘Two Genders’ Shirt To School

The U.S. Supreme Court declined to hear a student’s appeal challenging his school district’s ban on wearing a t-shirt reading, “There are only two genders.” Justices Clarence Thomas and Samuel Alito dissented, arguing lower courts distorted First Amendment rights.

The student’s guardians sued the Middleborough, Massachusetts school citing the 1969 Tinker v. Des Moines precedent protecting student speech. The school argued the shirts disrupted learning and harmed transgender students’ mental health.

Meanwhile, the Supreme Court is reviewing another case on Tennessee’s restrictions on gender-affirming care for minors, which could impact laws across many states.

Chief Justice Roberts also paused transparency orders for the Department of Government Efficiency.
