SCOTUS Passes On Chance To Overturn Hawaii Second Amendment Ruling

The U.S. Supreme Court declined to review a Hawaii Supreme Court ruling that defied major Second Amendment precedents. Hawaii’s top court claimed the state’s values clash with public firearm carrying, stating no constitutional right exists to do so.

 

 

 

Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch criticized the decision but said the case was not ready for review since defendant Christopher Wilson still faces other charges. Thomas noted that the Hawaii court would have deemed the licensing laws unconstitutional if it followed U.S. Supreme Court precedent. He emphasized the right to invoke the Second Amendment in future cases.

Separately, the Court upheld a federal gun law restricting access for those under domestic violence restraining orders and reaffirmed the FDA’s authority over abortion pill regulations.
