The U.S. Supreme Court rejected Montana Republicans’ attempt to use the “independent state legislature” theory to overturn two state election laws. The theory suggested state legislatures should have near-total control over election laws, immune from state court review. The justices ruled that state courts can still review such laws but are not unrestricted in doing so. Montana Secretary of State Christi Jacobsen sought to reinstate laws banning same-day voter registration and paid ballot collection, which the Montana Supreme Court had invalidated. The Court declined to hear the appeal, leaving the lower court’s decision intact.
